A "State witness" is a witness whom the State intends to call. The term does not include a witness from whom the police took a statement but whom the prosecutor has decided not to call and has made available to the defence. This will arise only on very rare occasions. Such interviews may only take place after the prosecutor has agreed to them. The prosecutor will only give consent if he has been given sound reasons in support of this request. The State representative will normally insist on being present when such an interview is conducted.
